JAMMU, Dec 30: The 2nd Additional Sessions Judge Jammu, Amit Sharma, today sentenced three brothers to life imprisonment in connection with a murder case from 2014.
The convicted brothers—Harvinder Singh, Amarjeet Singh, and Harcharan Singh, sons of Lakhmir Singh of Railway Patri, Tali Morh, R.S. Pura—were found guilty of murdering Harnek Singh of R.S. Pura on January 8, 2014, over a personal enmity.
After hearing Additional Public Prosecutor Arvind Rathore for the Union Territory and Senior Advocate Sunil Sethi for the defense, the court ruled that the case did not fall under the “rarest of rare” category, which would have warranted the death penalty.
Sentencing Details:
- Harvinder Singh was convicted under Sections 302, 307, and 34 RPC, along with the Arms Act (Section 4/25). He was sentenced to life imprisonment and fined ₹10,000 for murder, five years of imprisonment with a ₹5,000 fine for attempted murder, and one year with a ₹1,000 fine for violating the Arms Act.
- Harcharan Singh received life imprisonment and a ₹10,000 fine for murder, five years of imprisonment with a ₹5,000 fine for attempted murder, and additional imprisonment in case of default.
- Amarjeet Singh was sentenced to life imprisonment under Section 302 RPC, five years with a ₹5,000 fine for attempted murder under Section 307 RPC, and one year with a ₹1,000 fine for mischief under Section 427 RPC.
The court emphasized that while the crime stemmed from personal enmity, it did not meet the threshold for capital punishment. In the event of default in paying fines, additional imprisonment terms were specified for the convicts.
The sentencing brings closure to a decade-old case, with the court’s judgment reaffirming the commitment to justice while upholding the legal framework surrounding punishments.
